China's Death Sentence for Murderer

Yao Jiaxin, a university student who stabbed a young mother to death after knocking her down with his car in a traffic crash in October 2010, was sentenced to death on Friday by a court in Xi'an, capital of Northwest China's Shaanxi province.
Yao, 21, a junior at the Xi'an Conservatory of Music, ran into Zhang Miao while she was riding a bicycle. Yao was driving a Chevrolet Cruze at the time of the crash, which occurred at 10:30 pm on Oct 20. Fearing that Zhang would remember his license plate number and report him to the police, he stabbed her to death, according to the Intermediate People's Court of Xi'an.
The court also handed down a life-long revocation of Yao's political rights and ordered Yao to pay 45,498.50 yuan ($6,983) in compensation to Zhang's family.
After the stabbing, Yao drove away from the scene and, in his hurry to get away, injured two bystanders. In an interview with police on Oct 22, he denied he had committed the murder.
The next day, though, he surrendered himself to police in the company of his parents and admitted to being responsible for the killing, the court said.
Yao said he resorted to murder because he feared the "peasant woman would be hard to deal with".
On the night of her death, Zhang, 26, the mother of a 2-year-old boy, was returning home from her temporary job as a cafeteria assistant at the Chang'an campus of Northwest University.
Police said the crash left her with a small fracture in her leg and other slight injuries.
Yao, after hitting the victim, did not try to help her but instead resorted to murder to silence her. That split-second decision made his crime heinous and eliminated a possibility that he would receive a lesser punishment, the court said on Friday.
In China, criminals who turn themselves in are occasionally granted lesser punishments than those who do not.
"The motive was extremely despicable...the conduct was extremely cruel...and the consequences are extremely serious," the court judgment said.
Yao, when asked if he wants to appeal the sentence, said he needs time to make such a decision.
Relatives of Yao and Zhang, as well as hundreds of journalists and students, were present for the judgment.

Introduction of PlayStation 3

The introduction of Steam to PlayStation 3 has ensured both Sony's console and the PC are "one big happy family," Valve programmer Jeep Barnett (fantastic name) has told PSM3.

Speaking in an interview published in the mag's latest issue - which is on shelves next week - Barnett said cross-platform play between the platforms (see it in action here) gives players the freedom of convenience.

"Some people who have PS3s... I'm not going to say all, but I'm going to say a majority, also play PC," he said. "So the people who play on PC who have a Steam account will be able to play with PS3 friends and PC friends."

Barnett told PSM3 the new relationship between Valve's PC service and PS3, "gives people the freedom to play on the hardware that's not only of their preference, but also their convenience".

"What were two separate universes is now one big happy family," he said.

Currently Valve's digital distribution service is available on PS3 in the form of its development suite, but Barnett says he'd "love" to see full game downloads in the future.

"I'd love to see that," he told PSM3. "Maybe I'm answering these too personally. I think it's a great idea and it's going to become much more common.

"Having downloadable games is another one of those inevitabilities, like it was with the music industry. It's on the way."

Apple Filed Suit Against Samsung

Apple filed suit against Samsung last week because it had "crossed the line," a top Apple executive said Wednesday, but hopes to maintain a "strong relationship" with the South Korean company.
Apple was Samsung's second-largest client in 2010 after Japan's Sony Corp, accounting for four percent of the South Korean firm's 155 trillion won ($142 billion) annual revenue. Samsung provides many key hardware components for the iPhone and iPad. In February, the Wall Street Journal reported that Apple spent $7.8 billion for Samsung components, including LCD panels, flash memory, and A4 and A5 mobile processors designed by Apple and manufactured by Samsung.
Apple filed suit against Samsung in San Francisco on Friday alleging that the South Korean giant copied its smartphones and tablet computers.
Apple's company claims Samsung's mobile phones and Galaxy Tab imitated the iPhone and the iPad.
Samsung's Galaxy Tab has been the best-selling rival to the iPad, which has dominated the growing market for the touchscreen devices.

The Real Owner of Spratly Island Philippines or China?

China has countered a Philippine diplomatic protest at the United Nations by saying it has indisputable sovereignty over the Spratly islands that the Southeast Asian country "started to invade" in the 1970s.

China's diplomatic note to the UN, a copy of which was seen by The Associated Press, said the Philippine occupation of some islands and reefs in the Nansha islands infringes on China's sovereignty. The Spratlys are known to the Chinese as Nansha islands.

A Philippine protest filed to the UN earlier this month said China's claim to islands, adjacent waters, seabed and subsoil in the South China Sea had no basis in international law. The territorial claims were detailed in a map submitted to the UN in 2009.

The Philippines, China, Brunei, Malaysia, Taiwan and Viet Nam claim in whole or in part the Spratlys - a group of islands, reefs and atolls in the South China Sea believed to be sitting atop vast oil and gas reserves.

Viet Nam and Malaysia filed protests in 2009 against China's map, and Indonesia, a nonclaimant to the disputed territory, also protested last year.

The protests are registered with the UN Commission on the Limits of the Continental Shelf, which will help mediate conflicting claims on territories.

'Totally unacceptable'

China said the contents of the Philippine diplomatic note "are totally unacceptable to the Chinese government".

The Philippines has said the Kalayaan Island Group in the Spratlys was an integral part of the country, which has sovereignty and jurisdiction over nearby waters and geological features under the international law principle that land dominates the sea.

China said the Kalayaan Island Group was part of its Nansha islands and its sovereign and related rights were supported by abundant historical and legal evidence.

It said before the 1970s, the Philippines never made any claims to the islands in a series of treaties defining its territory.

"Since the 1970s, the Republic of the Philippines started to invade and occupy some islands and reefs of China's Nansha islands and made relevant territorial claims, to which China objects strongly," said China's April 14 note to UN Secretary General Ban Ki-moon.

China said the doctrine that a legal right cannot arise from an unlawful act applied, thus the Philippines could not rightfully claim the islands.

Asked for comment, the Department of Foreign Affairs (DFA) of the Philippines said the note verbale sent by the Philippine Permanent Mission to the UN "speaks for itself".

As promised, all left over legal defense money, plus a little to bump it to a nice number, has been sent to the EFF. Thank you all so much for your support, without it, things could have been much worse.
This money goes to the EFF in hopes that America can one day again be a shining example of freedom, free of theDMCA and ACTA, and that private interest will never trump the ideas laid out in the constitution of privacy, ownership, and free speech.

iPhone 5 with Video Recording?

iPhone 5 to Power 12.6 Megapixel Camera and 1080p Video Recording?
Well, I hope to see such rumors come true on the upcoming iPhone 5. OmniVision, known for producing out-of-the-box digital imaging solutions, supplied Apple with the back camera sensor for iPhone 4. The California based company has recently produced new sensors called OV12825 for the cameras of upcoming smartphones. The newly developed sensor, which will enter the production stage around early June, will offer 12.6 megapixel resolution along with 1080p video recording on 60fps.

Though, no one has yet placed orders for this futuristic sensor, since Apple has previously been including OmniVision sensors, the windows are open. On the other hand, some early rumors with semi-strong basis suggested that Apple will be ditching OmniVision for Sony for a 8MP sensor.

Since the iPhone 4 offers magnificent image sensor and Apple has previously been working with OmniVision, there’s a great chance that Apple may stick to OmniVision for OV12825. If this goes as hoped, the iPhone 5 will be a dream phone for photographers.
